The Federal High Court sitting in Abuja on Tuesday struck out the application by the Department of State Service seeking to revoke the bail earlier granted to four of the detained aides of Sunday Adeyemo, popularly known as Sunday Igboho.
The order striking out the application came after the lawyer to the DSS, Idowu Awo, informed the court of his intention to withdraw the application.
The application earlier filed had sought to revoke the bail granted to four of the 12 detained Igboho’s aides.
Awo noted that the reason for the withdrawal was because the DSS had already filed an appeal challenging the bail granted to four of the aides at the Court of Appeal, hence there was no need to continue with the application before the Federal High Court.
“We, therefore, seek to withdraw the motion on notice filed on August 9, 2021, while we intend to pursue an appeal,” Awo said.
The quest to withdraw the application was not opposed by the counsel to Igboho’s aides, heence, the court struck out the application.
Recall that Justice Obiora Egwuatu had granted bail to the 12 aides on August 4. Justice
The bail was granted following the suit instituted by the Igboho aides challenging their arrest and continued detention since July 1 when they were arrested in the house of Sunday Igboho in Ogun State.
The lawyer to the Igboho aides, Pelumi Olajengbesi, had argued that their continued detention violated the provisions of the constitution.
