His Lordship, Justice Phoebe Ayua of the Federal High Court in her judgement on Wednesday struck out the case for lack of merit.
A Federal High Court sitting in Port Harcourt, Rivers State, has upheld the candidature of Dr. Joseph Obele as the authentic governorship Candidate of the African Action Congress (AAC) for the 2023 general elections in the state.
A self-acclaimed factional Chairman of the party, Mr Progress Ogbokuma, had approached the Federal High Court sitting in Port Harcourt to nullify the primary election that brought in Dr Obele and recognize his purported primary election.

By the judgement today, the court cases concerning AAC had ended and Dr Joseph Obele remains on the ballot as the authentic governorship candidate of AAC in Rivers State.
In his response after the court ruling, Obele said, “God is to be glorified for the victory at the Federal High court. It is a victory for the redemption of Rivers State; a victory for job creation for the youths of Rivers State.”
He also called on all aggrieved members of AAC to let go of their differences with the aim of moving the party forward.
He recalled that the AAC took the second position at the last governorship election in Rivers State, adding that the party would definitely win the forthcoming governorship election in Rivers State.
“We are already preparing for the swearing in ceremony on May 29, 2023,” he said.
He thanked the party chairman, Dr Nenya Kocha, and the presidential candidate of the party, Omoyele Sowore, for granting him the privilege to run on the ticket of the party.
