A middle aged woman named Alhaja Aishat Adenike Popoola has charged her husband Alhaji Popoola Ogundoyin, the owner of Poplat petrol stations in Ibadan and Ile-Ife to the High Court Of Justice, Osun State over the sale of a four bedroom flat apartment.
The Four Bedroom Flat building, situated at No. 7, Awotorebo Street, Awotile Layout, originally built by one Oluwadamilare Kolawole, was bought by Alhaji Popoola in 2008 at the rate of ten million Naira ( N10m).
The oil Marchant in turn sold the property to Mrs Adefunke Deborah Awoyele, a native of Ile-Ife but resident of Ibadan at the rate of N 15m on the 24th of July 2019.
After necessary documentation on the transaction and the handing over of the property to the latest buyer, the seller’s wife, Alhaja Popoola, now charged both her husband and the buyer to Court, accussing her husband (first defendant) for selling the building without her consent, and labelling the second defendant as usurper on the property.
She claimed that her husband had on February 10, 2010 given the four bedroom flat property to her with all necessary documents.
Her councel, Barrister Remi Ayoade served both the first and second defendants court order praying the Court to compel her husband to reverse his action on the sale of the building and to also withdraw all the documents on the said property.
The second defendant had, through her counsel, Barrister Ifedayo Olowoyo replied to the sumbission of the Plaintiff, that his client does not in any way know the plaintiff nor had any business with her.
Barrister Olowoyo argued that if the plaintiff has any issue with the first defendant on the property which his client had legally bought with all necessary documents, she should settle it with the first defendant since they claim to be couple.
The case had earlier been heard at the same Court on Thursday, 16, July, 2020.
Following the prayer by councels to the second defendant (Mrs) Awoyele that they be given adjournment for them to study the claim which was forwarded to them by the counsel to the plaintiff so that they can have enough time to go through it and give necessary reply.
Justice, Dr. A. A. Aderibigbe has however adjourned the case to the11th of November, 2020 for further hearing.
